SURF TO MOUNTAIN TERMS AND CONDITIONS

1. Bookings
The person/company making the booking is held responsible for the conduct of all other occupants by this booking, including the condition of the property, its contents and surroundings.

2. Security Deposit:
A $500 security bond is required. If Surf to Mountain deem there is damage and/or complaints caused by guests, then we have the right to keep the full amount of the bond.

3. Use of Spa
Spa hours are from 9:00am – 10:00pm. Please do not use the spa outside these hours. Jets are not to be used after 9:30pm
Guests are not to adjust the timer and/or heat settings on the spa. No glass is to be used in the spa.

4. Deck Area
Guests must refrain from making excessive noise while sitting on the deck area (this includes swearing and anti- social behaviour, drunkenness etc). Please move off the deck area by 10:30pm. If you do need to use the deck area after 10:30pm (for smoking, getting fresh air, views etc) this must be done with minimal noise.

5. Noise
Noise curfew is between the hours of 9:30pm – 9:00am. This includes playing loud music, yelling, rowdy/anti- social behaviour etc. If you wish to play music after 9.30pm, this must be played quietly from inside the house and not be heard outside of the house or by neighbours. Failure to comply with the noise curfew will result in a loss of bond.

6. Parties
Parties are NOT permitted under any circumstances at the property and there is to be no disturbing noise between 9.30pm and 9:00am (with no excessive noise at any other time). In the event an unsolicited event/party or noise complaint at Surf to Mountain, then the procedure is as follows:
• The owner will phone/text first and attempt to resolve the concern.
• If a resolution is not forthcoming you will be asked to vacate the premises
• Police may be contacted.
• You risk losing all or part or your bond.
By booking Surf to Mountain, you agree to take full reasonability of any fines issued by the police and/or councils during your agreed accommodation.

7. Behaviour
Guests must refrain from anti-social behaviour (including swearing, yelling, etc) and respect the residential amenity. You are reminded that our house is situated in a residential area with families nearby. Disturbance to neighbours, including excessive noise or anti-social behaviour during the day and night is prohibited and may result in the termination of the booking and/or loss of bond. If your behaviour or that of your guests causes damage, danger or annoyance we reserve the right to ask you to vacate the property immediately. There will be no refund for any unused portion of the booking.

8. Property Usage
The property is to be used for short term residential accommodation (holiday letting) only. The property may not be used for any commercial purpose, wedding, party, gathering or any other function.

9. Guests Numbers
Under no circumstances will the number of people occupying the property be greater than that specified in the confirmation booking. The house is for registered occupants only. If the maximum number of occupants is breached, then you will forfeit your entire security bond and directed to leave the property. There will be no refund for any unused portion of the booking. Any increase in numbers must be agreed in advance and may incur additional fees.

10. Visitors
Surf to Mountain is only to be used by guests in booking. No outside guests are permitted on the premises without pre-arrangement from Surf to Mountain.

11. Check-In, Check-Out & Keys
Guests will be provided with a security code for keys prior to arrival. All keys are to be locked back into the security box after departure. Loss of keys will result is a $250 loss of security bond. We recommend using the lock box on day trips.
Check-in is from 4.00pm onwards and check-out is 10.00am. If cleaners are held waiting by guests departing after 10:00am all cleaners’ fees are at $45 per hour per cleaner for time waiting and will be deducted from the bond.

12. Internet
Satellite Wi-Fi is available at Surf to Mountain but unfortunately this has limitations. Surf to Mountain will not be held responsible for poor Wi-Fi or loss of Wi-Fi connection. Smart Televisions have been locked from using Apps (such as Netflix, Sta, YouTube) due to limited internet and data availability. No streaming of movies is available.

13. Parking
Please use the carport and driveway for parking. Under no circumstances are you to park on neighbours nature strips or driveways.

14. Cleaning
The occupants are required to leave the property in the same clean, neat and tidy condition, as it was when they arrived. This includes, without limitation, washing up, fridge cleaned and wiped out, BBQ cleaned, dishwasher emptied and rubbish to be placed in appropriate bins provided on vacating the property. If additional extra-ordinary cleaning is required, the cost will be charged against your security bond.

15. Rubbish
If you happen to be a guest during rubbish evenings, it is a guests' responsibility to ensure the bins are available for council collection. Bins must be placed out on the roadside Wednesday nights for Thursday morning pick up. Bins must also be placed on roads the day of departure.
Any additional rubbish that can’t fit in the bins must be removed by the guests. Under no conditions are the bins to be overfilled or neighbours’ bins used. If the bins are full, then it is the guest responsibility to take the rubbish from the property. There are extra garbage bags under the kitchen sink to take rubbish home. Alternatively, you can drop rubbish off at Mansfield Resource and Recovery Centre (please visit their website for address and hours). We apologise for the inconvenience, but we place a real emphasis on keeping our lovely area tidy and free of rubbish.

16. Smoking
There is strictly no smoking inside the property. Failure to comply will result in an immediate loss of bond. If smoking outside the property, please dispose of cigarettes appropriately. Please do not dispose of these on the ground. Any butts left on the ground around the property will result in full loss or part loss of bond.

17. Pets
Pets are welcome at the property if agreed to by Surf to Mountain. Please contact Surf to Mountain for our Pet Policy. An extra fee be will be charged for pets.

18. Security.
For the safety and protection of the property owners, guests, our home and neighbours, security cameras are situated at the front (carport) and rear of the home (on back deck) (external only). These cameras are not to be intrusive of your stay, but to merely protect our home. By booking Surf to Mountain, you are giving consent to recording of footage (including audio). Tampering with cameras will result in loss or part loss of bond.

19. House rules:
A breach or indicated breach of any of the above conditions will permit Surf to Mountain to cancel or amend a booking, refuse access or occupancy or immediately terminate any accommodation. Refunds will not be paid on terminated accommodation and penalties will apply in the event of parties/events.

As the property is an individual house and not a hotel with staff where rooms can be swapped, we cannot offer alternative accommodation or a refund if the property is not to your individual taste. We encourage guests to choose this property carefully and ask any questions you wish.
We do not refund for problems such as, but not limited to, plumbing, electrical, gas, television, stereos, WIFI not working, light globes out, any appliances or spa not working, blackouts etc. We will endeavor to fix all problems as soon as practically possible, but as this is an entire property, occasionally a few maintenance issues may arise; fortunately, most are easily fixed. It is therefore paramount you make your property selection carefully.

Minor interior and exterior decorations change from time to time in order to maintain the property. Images on websites are not always an exact representation of the property as changes can and will occur to keep a property fresh.

20. Loss, Damage or Injury:
Surf to Mountain takes no responsibility for loss or damage of any property, or personal injury or death, of any occupant, guest or invitee of any such occupant and they each exclude all liability to the maximum extent permitted by law. The occupants acknowledge the environment in which the property is located and must take extreme care including, without limitation, observing safety signage, fire and safety directions and procedures and exercise caution whilst inside and when venturing outside the property.
Whilst you are in occupation, you are fully responsible for all breakages and damage caused to the property, its furniture, fittings, or any consequent loss suffered by the property owner. Occupants must report breakages immediately (or as soon as practically possible) and are responsible for loss or damage of property belonging to them, or their guests, and for the damage or loss of property belonging to the property during their stay.
Please be aware of any surrounding natural bush land as there may be dangerous snakes, spiders and other animals and bugs. If you are sensitive, please insure you use an insect repellent and wear covered shoes if you are bush walking.
Surf to Mountain is located near a National Park and will not be held responsible for guests who do not leave the property during fire season or bushfire. Please take appropriate precautions and leave the property early if a fire is near or in the area.


21. Travel Insurance
We recommend travel/health insurance as security for the event of accidents, sickness or cancellation caused by unforeseen circumstances. These include but are not limited to events such as transport problems, illness, bushfires, floods, storms, death, government restrictions, Covid-19, extreme weather conditions or lack of snow.

22. Standard Cancellations:
Surf to Mountain has a 30 day policy as follows.
- 100 % refund if you cancel at least 30 days before check-in.

Bookings through 3rd Party Platforms may differ from the above.

23. Cancellation due Covid-19 Pandemic
Upon booking Surf to Mountain, guests are aware of the risks associated with Covid-19. Guest are booking with the full knowledge of the possibility of their stay being impacted by Covid 19 and the consequences of Coronavirus are no longer unforeseen or unexpected. The following conditions apply for all bookings.

a) If government restrictions stop Surf to Mountain from operating, a full refund will be given (minus $200 administration fee). Please note that we cannot refund booking fees through 3rd Party platforms (such as Stayz, AirBNB, Riparide). All issues with 3rd Party booking fees must be between the guest and 3rd Party.

b) If guests are unable to travel due to government restrictions (eg. Local government lockdown, restrictions on numbers) but we are still able to operate, guest are offered a full credit to be used in an off-peak period. This credit is valid for 12 months. The booking must equate to the same value as the original booking.

OR

Alternatively, guest may limit their numbers to adhere to government policies (single households etc)

OR

Guests are refunded 50% of their booking (minus the booking fees with 3rd Party bookings). If Surf to Mountain can secure another booking (through advertising), then Surf to Mountain will refund the remaining 50% of the booking amount.

c) If a cancellation is made before a government announcement for the dates booked, then the bookings proceed as though there are no restrictions in place for the dates and revert to the standard terms and conditions.

24. Changes to Terms
Surf to Mountain reserves the right to change these Terms with or without further notice to you and without giving you any explanation or justification for such change.
If we make any substantial changes, we may notify you by sending you an email to the last e-mail address you provided to us and/or by posting notice of the changes on the Surf to Mountain Website. These changes will be effective immediately for all users of our Services.

25. Confirmation:
That you and each occupant have read, agreed and accepted these terms and conditions. You also acknowledge that this contract terminates upon the final vacation of the property.
